EBH-E (4) Leasing and Renting – Use Agreement
THE BOARD OF PUBLIC EDUCATION FOR THE CITY OF SAVANNAH AND THE COUNTY OF CHATHAM USE AGREEMENT


Persons or groups using The Board of Public Education for the City of Savannah and the County of Chatham facilities/equipment do so under the following conditions:

1. The Board of Public Education for the City of Savannah and the County of Chatham shall:
a. Furnish lights, electric power, water, and other support or resources as it may, at its sole discretion, deem feasible or appropriate for the purposes of the users.
b. Reserve the right to cancel this use agreement if it is found that the facility is needed for school use.
c. Reserve the right, in the exercise of its discretion, to rescind and cancel this use agreement at any time when, in its opinion, the purpose for which the premises herein described are being used, or intended to be used, shall be obnoxious or inimical to the best interest of The Board of Public Education for the City of Savannah and the County of Chatham; anything herein contained not withstanding.

2. The User shall:
a. Hold the Board of Public Education for the City of Savannah and the County of Chatham, its officers, agents and employees harmless from any damage or accidents or injury that may happen to the User or his agents, servants, employees, or property from any cause whatever, prior, during or subsequent to the period covered by this Agreement, and the said User hereby releases The Board of Public Education for the City of Savannah and the County of Chatham from the agrees to indemnify it against any and all claims for such occurrences.
b. Pay for contract and other costs incurred by such usage.
c. Obtain at the User's own cost and expense any and all licenses or permits required by law or ordinance. User evidence of liability insurance coverage may be required.
d. Take the premises as they are set up at the time of occupancy by the User. In the event the User finds it necessary to have removed or change the location of any stage rigging or equipment, the changes shall be made by the Owner at the User's expense. No removals or changes shall be made without prior consent and support from the school/site principal/administrator.
e. Remove from the premises within twenty-four (24) hours following the final performance, all stage settings, equipment and material owned by the User. Anything not removed from the premises after 24 hours may be subject to storage charges.
f. Have all deliveries of needed stage equipment and scenery made with the consent of the school principal/administrator.
g. Honor the agreement for the purpose a specified, unless written consideration is obtained from The Board of Public Education for the City of Savannah and the County of Chatham.
h. Prohibit the use of intoxicating or alcoholic beverages, harmful drugs, or gambling devices of any kind. The use of tobacco or tobacco products on Board of Education property is expressly prohibited.
i. Forbid the use or storage on any part of the school premises any substance or thing prohibited by any law or ordinance, or by standard policies of fire insurance companies operating in the State of Georgia.
j. Obtain permission from the school principal/administrator before using, storing, or permitting to be used or stored, in or on any part of the school premises any illuminating oils, candles, lamps, turpentine, benzene, naphtha, or other similar substances or explosives of any kind.
k. Pay federal admission taxes directly to the government.

3. The following regulations shall be followed:
a. Property of the Board of Public Education for the City of Savannah and the County of Chatham shall not be removed from the school under any condition.
